Planning & Building Regulations: What You Need to Know

The Pace of Change: The pace of change in construction technology shows no signs of slowing down.  We have learned some hard lessons along the way, which is why we guide you through all regulatory requirements.

Relaxed Planning Regulations (Permitted Development)

Recent changes in planning legislation have made it easier to obtain permission for garden offices.  While it is essential to consult with your local authority, general guidelines are as follows:

  • Permitted Development: You generally don't need planning permission if it's under 30 meter square, single-story, under 2.5 meters tall (near boundaries), not used for sleeping, and doesn't take up over 50% of your garden.
  • Size and Location: The structure should be no higher than 2.5 meters and occupy a maximum of 50% of the garden area.  It must be situated in the back garden unless specific permission is granted.
  • Conservation Areas and Listed Buildings: Properties located in conservation areas may have additional restrictions, and owners of listed buildings will typically require full planning permission.

Building Regulations: Standards of Quality

Building Regulations are crucial and apply more strictly if your office is: Over 15 meters (and not more than 1 meter from a boundary); Over 30 meters; Includes sleeping accommodation (even occasionally); or features mains electricity, plumbing, or heating.

Specific Standards:

  1. Insulation (Part L): Must be energy-efficient.
  2. Electrical Safety (Part P): All permanent wiring needs to comply, requiring qualified electricians.
  3. Fire Safety (Part B): Addresses materials and distances from boundaries.
  4. Boundary Rules: If over 15 meter square, it must be at least 1 meter from the boundary to avoid building Regs (unless built of non-combustible materials).
